The Four Step Process involved in Applying for Veterans Benefits

Applying for Veterans benefits involves the following four step process:

  • First Step: An Application for Compensation must be submitted. Typically, the VA will then provide forms it needs from you to process your application. After your request for disability benefits has been filed, the VA will collect your military medical records. In some cases, the VA may ask that you be examined by a VA doctor. Once your application is reviewed, a Ratings Decision will be issued informing you of the VA's decision.
  • Second Step: If the VA denies your request for benefits, you can appeal their decision by filing a Notice of Disagreement. The Notice of Disagreement must be filed within one year of your initial denial. Afterwards, the VA will send you a Statement of the Case. At this stage of appeal, you can submit additional medical documentation to your local VA, along with your appeal. After your appeal is considered, the VA will send you a Supplemental Statement of your case.
  • Third Step: If your appeal is denied at the second stage, you can appeal your case to the Board of Veterans Appeals. Here, you have only 60 days within which to submit your appeal after being denied. Or, after receiving your Ratings Decision, you have 100 days to appeal. After receiving your appeal at the third level, the Board of Veterans Appeals will ask a Ratings Officer to review your case and make a decision.
  • Fourth Step: If your case is denied at the third stage, you can appeal to the United States Court of Appeals for Veteran's Claims. You must file your appeal within a 120 days of the Board of Veterans' decision.
