Carol Rosenbloom Associates, LLC | Pittsburgh, PennsylvaniaPersonal Injury Lawyer • Car Passenger Injury • Driver NegligenceBecause of the way many cars, vans, busses and trucks are designed, passengers, especially children, often suffer the most serious injuries in motor vehicle accidents. Most individuals do not know about the inherent dangers of 15-passenger vans. These 15 passenger vans are frequently used by organizations to transport large groups of people and cargo to and from activities. All too often Churches, Colleges, and Businesses use the 15 passenger vans on a regular basis. These15-passenger vans have a design defect causing them to fishtail and rollover due to the fact they are extremely top heavy. Fifteen passenger vans have a very high center of gravity and when they are overloaded, they become very unstable. These vans can cause a great deal of harm to anyone involved in an accident while a passenger. Passengers can also be injured by the operation of cars, vans, busses, and other vehicles., such as, cases involving off-road vehicles. For instance, passengers in other motor vehicles, such as golf carts, may recover from the operator of the golf cart when an accident is caused by the operator's negligent operation. Small low cost vehicles are being increasingly used for general transportation, according to a study release in June of 2008. Part of the problem is that the carts are faster than they used to be causing the number of injuries to double from 1990 to 2006. The carts are also being used in ways they were not necessarily intended for and are carrying people-especially children. Many of the injuries were caused by falls, which can occur at speeds as low as 11 miles per hour when the cart turns. The newer carts can hit 25 mph. They often lack safety equipment, such as, seat belts. A lack of front brakes makes the vehicles prone to fishtail. In addition to being injured by falling out, riders are hurt when the cart turns over. There is little federal regulation, and most states do not require operators to be of a certain age, use any sort of safety equipment or obtain an operator’s license. In one lawsuit, the passenger claimed that the operator made a sudden abrupt turn with the golf cart, causing the passenger's body to shift and her right leg to drop out of the right side of the cart. The operator then turned the golf cart close to the adjacent golf cart causing the passenger's leg to become wedged between the two carts. The passenger testified that the operator continued to drive the cart forward, which further wrenched and twisted her leg. A jury found the operator 100% negligent. Even though passengers may not always be afforded the best protection by auto-makers, they are afforded more protection under the law. The law allows injured car passengers to seek financial compensation from the insurance carriers from BOTH drivers involved in the accident and potentially from other sources as well, regardless of whether driver negligence caused the accident.
