Dog Bite Attorney • Animal Attack Lawyer Premises • Liability Attorney
The following are several tips that all victims of dog bites should follow so that they may protect their legal rights:
- Take care of yourself or your loved one--seek medical attention immediately.
- Be sure that you can identify the dog involved in the attack.
- Get the name, address and telephone number of the dog's owner.
- If possible, get the homeowners' insurance and dog license information from the dog's owner.
- Get the names, addresses and telephone numbers of any and all witnesses.
- Take photos of all injuries sustained in the attack.
- Consult an attorney immediately before signing any documents, speaking with an insurance company or accepting any money.
Generally, a dog owner is responsible for the injuries caused to another, such as a mailman by his or her dog when he or she knew or had reason to know of the dog's vicious propensity.
This has been incorrectly called the "one free bite" rule. This rule that every dog is entitled to one free bite is not true. A dog may show vicious propensities without biting anyone and, if he does so, it is his master's duty to see to it that the dog is not afforded an opportunity to take a first bite. A jury has found a dog owner liable when a United Parcel Service (UPS) delivery man was bitten through a storm door that had broken. A dog owner may be held liable where an individual such as a mailman was harmed not by the bite of a dog, but by the actions of the dog which lead to a non-bite injury. This may occur when a dog chases or surprises someone such as a mailman and that person falls.
Landlords can also be Liable!
At Carol Rosenbloom Associates, LLC, we can tell you that in Pennsylvania a landlord may be liable for injuries caused by a dog owned by a tenant when certain conditions are met.
This is good news. Some dog bite and exotic animal attack claims are covered by a homeowners' insurance policy. However, even if dog bites are excluded from a homeowners' insurance policy, our personal injury lawyers can work with you to obtain compensation from a dog's owner. Our attorneys can quickly evaluate the facts of your case and give you an honest opinion about the damages that may be available in your case. Should you decide to proceed with our firm representing you, we will work hard to handle your case as efficiently and quickly as possible in order to get you the help that you need to deal with your medical bills, lost wages, and recovery.
Our firm represents dog bite and animal attack victims throughout west-central Pennsylvania. We offer free initial consultations. The majority of our services are provided on a contingent fee basis which means that you will pay no attorneys' fees unless we are able to achieve a verdict or settlement on your behalf.
