Alison Pregliasco and her daughter were on their way to Disney World when the little girl's Croc became entangled in an airport escalator. According to the report, it took 15 minutes to remove the child's right foot from the escalator. She had three broken toes and had to have surgery that involved the insertion of pins in her foot and the cleaning of bones to remove skin contaminated with escalator grease. The mother of the injured girl maintains the Croc Company knew their product could cause harm and did nothing to warn people. The Croc Company has been aware of this situation. A prior lawsuit was filed by the family of another three-year-old who was involved in an escalator entrapment at JFK Airport in New York. Furthermore, May 2008 Consumer Reports issued a warning about wearing the rubber shoes on escalators. SCHOOL BUS ACCIDENTSA lot of parents entrust their children to school bus drivers to deliver their children to and from school. It has been reported that approximately 12,000 children are injured each year. While most injuries are minor, some are catastrophic and even result in death. Many school buses do not have restraint systems or seatbelts. A school bus accident may occur for a number of reasons: driver negligence, defective products and weather. GUNSAnother tragedy to children involves handguns. A gun owner must be responsible in allowing access to the handgun. Many times, guns are left lying around, only to be found by a child, who picks it up out of curiosity, pulls the trigger and is seriously injured. If the gun owner is a homeowner, there might be homeowner’s insurance that compensates the victim of such a shooting. DPW REIMBURSEMENTWhen a child is injured and the medical charges are paid by medical assistance or DPW, DPW asserts that a parent has to reimburse DPW out of any recovery on behalf of the child. However, at least one appellate court and one court in The Court of Common Pleas in Allegheny County Pennsylvania, in certain circumstances, ruled that DPW is not entitled to reimbursement for medical assistance payments from the proceeds of a medical malpractice settlement distributed to a child.
