Carol Rosenbloom Associates, LLC | Pittsburgh, PennsylvaniaDefective Air Bag and Tire Attorney ● Products Liability LawyerDefective automobile airbags and tires can cause severe injuries and even death. Even though airbags have been credited with saving lives, these devices have problems, including the following: •Airbags that deploy when they should not.•Airbags that deploy with too much force. •Airbags that deploy too slowly. •Airbags that deploy in low-speed accidents. •Airbags that fail to deploy. The Kansas City Star has recently examined thousands of fatal crashes. Their staff found a surprising number of deaths that might be blamed on faulty airbags. If their analysis is correct, at least 1,400 people died from 2001 to 2006 in frontal crashes when their cars’ airbags did not inflate at all. The story says all manufacturers have had reports of defective airbags. Defective airbags aren’t the only problem in many of today’s cars. There maybe millions of faulty Chinese tires on the highway. Many tires were made by Hangzhou Zhongce Rubber Co. Foreign Tires Sales of New Jersey which was responsible for bringing the Chinese made tires into the country. Other distributors may be involved. The tires were sold under the names of Compass, Telluride, Westlake and YKS. The defect occurred because the manufacturer failed to place adhesive strips between the tire belts. The tires were also dangerous because their inner liners were too thin, permitting air to leak and damage the outer walls of the tire. On May 4, 2007, Foreign Tire Sales has been sued by the families of two men killed when the van they were riding in crashed near the town of Jim Thorp, Pensylvania in August of 2006. It is interesting to note that Foreign Tire Sales was aware of a problem. In fact, the company notified the federal government that it had safety concerns about the tires as a result of a crash by an ambulance in New Mexico in 2005. If you have been a victim of an accident involving any of the tires listed in the recall, please contact our office immediately to discuss your options. Compass, Telluride, Westlake and YKS Tires Recalled! The latest defective Chinese import involves tire-valve stems. These are the rubber shafts that allow motorists to fill their tires with air. Tech International of Johnstown, Ohio, an importer, issued a formal recall in June of 2008 and Dill Air Controls Products, another importer, alerted the National Highway Safety Administration (NHTSA), which has begun an investigation. Most of the valves in question, which are said to crack prematurely, appear to be sold on tires between September 2006 and June 2007. The defect may be caused by improper mixing of the rubber compound in the manufacturer’s facility. The stems were made in Shanghai by two companies with similar names and the same address. The dates of manufacture are the same as well. As of August of 2008, NHTSA has not issued a national alert. Hopefully, there won’t be any deaths or serious injuries while NHTSA is waiting to act. While contacting a lawyer is an important step in pursing any claim, sometimes a person’s claim is lost before the lawyer is contacted. In some car accidents the airbag fails to deploy or a tire blows out. The insurance company quite reasonably wants to resolve the claim for damage to the car. They buy it at salvage value and destroy it or ship it away never to be seen again. Once the vehicle is gone, it is likely that any lawsuit arising from the defective air bag or the tire goes away, as well. In order to prevail against a manufacturer, the airbag or tire must be retained. Without it, the court usually won’t allow the claim to proceed. So, if you suspect a product or piece of equipment failed, you should try to preserve the car in your possession, tell the insurance companies to preserve it (in writing) or contact an attorney as soon as possible.
